按照常理...如果頂樓大家都上的去(種花.養雞.種菜.曬衣服),且屬於共有的部分,那頂樓的防水一般都是要從管理費裡面支出,由管委會來處理才對,除非頂樓只有你家可以用,別的住戶無法進出使用,那才是您個人戶的問題;關於頂樓區分所有權的問題,可以查看看公寓大廈管理條例,雖然都文謅謅的,但還是可以看得懂;除非是剛交屋沒多久的成屋才會扯到建商的保固問題,你們都已經十多年了,還扯到建商會不會太誇張!!
